A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The situation originates in a mistaken removal to El Salvador in March, which the government later admitted was an mistake. Following his repatriation to the United States to answer alien smuggling allegations, he was held in federal custody.

In her order, the judge pointed out that the authorities lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
